# Terms of Service
## Article 1 – Definitions
The following definitions apply in these Terms of Service:
Cooling-off period: The period during which the customer may exercise their right to cancel an order.
Customer: The individual purchasing products from the entrepreneur for personal use and not acting in the course of a business or profession.
Day: Calendar day.
Distance contract: A contract concluded between the entrepreneur and the customer through a system of distance selling where communication takes place exclusively online until the agreement is completed.
Durable medium: Any method that allows the customer or entrepreneur to store information addressed personally to them in a way that allows future access and unchanged reproduction.
Right of cancellation: The customer's ability to cancel a distance contract within the cancellation period.
Entrepreneur: Casa Vera Home, the company offering products and services to customers through distance selling.
Remote communication technology: Means used to conclude a contract without the customer and entrepreneur being physically present together.

## Article 2 – Payment
Unless otherwise agreed, all amounts owed by the customer must be paid at the time of placing an order through the website.
The customer is responsible for providing accurate payment details and must notify Casa Vera Home immediately of any errors in the payment information provided.
If payment is not received, Casa Vera Home reserves the right to delay or cancel the order, subject to applicable laws.

## Article 3 – Applicability
These Terms and Conditions apply to every offer made by Casa Vera Home and every distance contract and order completed between Casa Vera Home and the customer.
Before completing an order, these Terms of Service will be made available to the customer.
If the agreement is completed electronically, these Terms will be provided in a format that allows the customer to save and store them for future reference.
If any provision of these Terms becomes invalid or unenforceable, the remaining provisions will continue to apply.
Any situations not covered by these Terms will be interpreted in accordance with the purpose and principles of these Terms.
Any uncertainty regarding the interpretation or content of these Terms shall be interpreted reasonably and fairly.

## Article 4 – The Offer
If an offer has a limited validity period or specific conditions, this will be clearly stated.

All product descriptions, images and information are provided as accurately as possible to allow customers to make an informed decision.
Minor differences in colour, appearance or specifications may occur due to screen settings or manufacturing differences.
Images and product information are intended as a representation of the products and do not guarantee an exact match.
Every offer clearly includes information regarding:
- The price of the product;
- Any applicable delivery costs;
- Payment methods;
- Delivery information;
- The cancellation and return policy;
- The process for completing an order;
- Any other relevant customer rights and obligations.

## Article 5 – The Agreement
The agreement between Casa Vera Home and the customer is formed when the customer accepts the offer and completes the order process.
When an order is placed electronically, Casa Vera Home will send an order confirmation by email.
Casa Vera Home takes appropriate measures to ensure secure online payments and protect customer information.
Casa Vera Home reserves the right to refuse or cancel orders where there are reasonable grounds, including suspected fraud, incorrect pricing, or product availability issues.
Customers will receive relevant order information electronically, including:
- Contact information for customer support;
- Return and cancellation conditions;
- Warranty information where applicable;
- Order details and product information.
Every order is subject to product availability.

## Article 6 – Right to Cancel
Customers have the right to cancel their order within 30 days of receiving the product without providing a reason.
The cancellation period begins on the day after the customer or their chosen recipient receives the product.
During the cancellation period, customers must handle the product and packaging with reasonable care.
If the customer wishes to cancel an order, they must notify Casa Vera Home in writing by email within the cancellation period.
After notifying Casa Vera Home, the customer must return the product within 30 days.
The customer must provide proof that the product has been returned, such as shipping confirmation.
If the customer does not notify Casa Vera Home of cancellation or fails to return the product within the required timeframe, the purchase will become final.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises their right of withdrawal, the costs of returning the products will be paid by the consumer.
If the consumer has paid an amount, the entrepreneur will refund this amount as quickly as possible, but no later than 14 days after cancellation. The refund will only be processed once the product has been returned to the entrepreneur or the consumer has provided sufficient proof that the product has been returned.

Article 8 – Exclusion of the Right of Withdrawal
The entrepreneur may exclude the consumer’s right of withdrawal for certain products if this has been clearly stated in the offer before the conclusion of the agreement.
The right of withdrawal may only be excluded for products:
- made according to the consumer’s specifications;
- that are clearly personal in nature;
- that cannot be returned due to their nature;
- that may deteriorate or expire quickly;
- whose price depends on financial market fluctuations beyond the entrepreneur’s control;
- individual newspapers and magazines;
- sealed audio/video recordings and computer software where the seal has been broken by the consumer;
- hygiene products where the seal has been broken by the consumer.
The right of withdrawal may only be excluded for services:
- related to accommodation, transport, catering, or leisure activities provided on a specific date or during a specific period;
- where delivery has started with the consumer’s explicit consent before the end of the cooling-off period;
- relating to betting and lotteries.

Article 9 – Price
During the validity period stated in the offer, prices of products and/or services will not be increased, except for price changes resulting from changes in VAT rates.
The entrepreneur may offer products or services with variable prices where prices are subject to financial market fluctuations beyond the entrepreneur’s control. This will be clearly stated in the offer.
Price increases within 3 months after the conclusion of the agreement are only permitted if they result from legal regulations.
Price increases after 3 months from the conclusion of the agreement are only permitted if agreed by the entrepreneur and:
- result from legal regulations; or
- the consumer has the right to cancel the agreement from the date the price increase takes effect.
All prices are subject to typing and printing errors. The entrepreneur is not responsible for the consequences of such errors. In case of a pricing error, the entrepreneur is not obligated to deliver the product at the incorrect price.

Article 10 – Conformity and Warranty
The entrepreneur guarantees that products and/or services comply with the agreement, the specifications stated in the offer, reasonable requirements of suitability and usability, and applicable laws and regulations at the time the agreement is concluded.
Any warranty provided by the entrepreneur, manufacturer, or importer does not affect the consumer’s legal rights and claims against the entrepreneur.
Defective or incorrectly delivered products must be reported to the entrepreneur in writing within 14 days of delivery. Products must be returned in their original packaging and in unused condition.
The entrepreneur’s warranty period corresponds to the manufacturer’s warranty period. However, the entrepreneur is never responsible for the suitability of products for every individual use by the consumer or for advice regarding the use or application of products.
The warranty does not apply if:
- the consumer has repaired or modified the products themselves or had this done by a third party;
- the products have been exposed to abnormal conditions, treated negligently, or used contrary to instructions;
- the defect results from government regulations regarding the nature or quality of materials used.

Article 11 – Delivery and Performance
The entrepreneur will take the greatest possible care when accepting and fulfilling product orders.
The delivery address is the address provided by the consumer.
The entrepreneur will process accepted orders as quickly as possible and no later than 30 days, unless a longer delivery period has been agreed.
If delivery is delayed or an order cannot be completed or can only be partially completed, the consumer will be informed within 30 days of placing the order.
In such cases, the consumer has the right to cancel the agreement without costs and may be entitled to compensation where applicable.
If the agreement is cancelled, the entrepreneur will refund any amount paid by the consumer within 14 days.
If a product cannot be delivered, the entrepreneur will make reasonable efforts to provide a replacement product. The consumer will be clearly informed before delivery that a replacement product will be supplied.
The consumer’s right of withdrawal cannot be excluded for replacement products. The entrepreneur will cover return shipping costs for replacement products.
The risk of damage or loss of products remains with the entrepreneur until delivery to the consumer or an authorised representative, unless otherwise agreed.

Article 12 – Duration, Termination and Renewal of Contracts
Termination
The consumer may terminate an indefinite contract for regular supply of products or services at any time, subject to agreed cancellation rules and with a notice period of no more than one month.
The consumer may terminate a fixed-term contract for regular supply of products or services at the end of the agreed period, subject to the agreed cancellation rules and a notice period of no more than one month.
The consumer may:
- terminate contracts at any time and not only at a specific date or period;
- terminate contracts in the same way as they were entered into;
- always terminate with the same notice period as the entrepreneur applies.
Renewal
A fixed-term contract for the regular supply of products or services cannot be automatically renewed for another fixed term unless legally permitted.
A fixed-term contract may only continue indefinitely if the consumer can cancel at any time with a notice period of no more than one month.
Trial or introductory subscriptions automatically end at the end of the trial or introductory period unless otherwise agreed.
Duration
If a contract lasts longer than one year, the consumer may terminate the contract after one year with a notice period of no more than one month, unless reasonable circumstances prevent early termination.

Article 14 – Complaints Procedure
Complaints regarding the performance of the agreement must be submitted to Casa Vera Home in writing, clearly and completely described, within 7 days after the consumer has discovered the issue.
Complaints submitted to Casa Vera Home will receive a response within 14 days from the date of receipt.
If a complaint requires a longer processing time, Casa Vera Home will respond within 14 days with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed response.
If the complaint cannot be resolved amicably, the dispute may be handled according to applicable dispute resolution procedures.
Submitting a complaint does not suspend the consumer’s obligations under the agreement unless Casa Vera Home confirms otherwise in writing.
If Casa Vera Home considers the complaint to be justified, Casa Vera Home may, at its discretion, repair or replace the delivered products free of charge.

Article 15 – Disputes
These Terms and Conditions are governed by applicable laws.
For customers in the United Kingdom, these Terms do not affect any consumer rights granted under UK consumer protection laws.

Due to regulations relating to electronic payment reporting, payment service providers may be required to collect and report certain payment information to relevant authorities where applicable.
